Aktieninstitut opposes lowering EMIR clearing thresholds
In a statement on ESMA's consultation on clearing thresholds under the EU Derivatives Regulation (EMIR), Deutsches Aktieninstitut opposes ESMA's proposal to lower the clearing thresholds. Companies with large derivative portfolios need the leeway provided by clearing thresholds even if they use derivatives exclusively for hedging purposes in risk management. This is because there are always cases of doubt that are then counted as non-hedging derivatives for the purposes of clearing thresholds.
