In her guest article, Dr. Christine Bortenlänger, Managing Director of Deutsches Aktieninstitut, takes a look at the still young format and highlights the need for further reforms. Of the Dax 40 shareholders, 87 percent were in favor of allowing virtual general meetings. At around 95 percent, approval for virtual participation of the supervisory board in the AGM reached an even higher level among companies from the Dax 40. One of the great advantages of the format is the ease of participation - not only for foreign shareholders, but for all shareholders. In an increasingly digital and sustainable society, the virtual AGM has found its place. However, the current law on defective resolutions needs to be reformed to allow for open debates at general meetings. This would benefit both face-to-face and virtual AGMs in equal measure.
