In his article "Balancing act between security and transformation. European Capital Markets Law 2023: Sustainability and Capital Markets Union at the Top of the EU Institutions' Agenda", which appeared in the special "Corporate Finance Law 2023 - Capital Markets - Private Equity - M&A", Jan Bremer, Head of the EU Liaison Office in Brussels at Deutsches Aktieninstitut, gives an overview of the most important legislative projects of the EU institutions. In it, he discusses, among other things, the EU Listing Act, the EU Commission's revision proposal for the European derivatives regulation EMIR, the development of the European Sustainability Reporting Standards (ESRS) by EFRAG's Sustainability Reporting Board.
His conclusion: European capital market law will continue to face decisive decisions in 2023. It is to be hoped that the Brussels players will succeed in balancing the need to ensure capital market-based corporate financing on the one hand and the transformation to a sustainable economy on the other - a Herculean task.
