EU Directive on Due Diligence in Supply Chains must provide legal certainty and should be proportionate
On the occasion of the ongoing Trialogue negotiations on the Corporate Sustainability Due Diligence Directive (CSDDD), we advocate for a risk-based approach with a prioritization of environmental and human rights risks by companies. The scope of the directive should only focus on direct suppliers. Indirect suppliers should only be included if the company receives substantiated knowledge of a breach of due diligence obligations. A liability clause should be designed in such a way that companies are only liable for damages they directly cause. The Directive should be aligned with existing international frameworks, such as the UN Guiding Principles on Business and Human Rights.
